Terms of Service

These Terms of Service ("Terms") govern your access to and use of TheTravella website, application("App"), and services (collectively, the "Platform") made available by Prodev Innovations Limited ("TheTravella," "we," "us," or "our").

PLEASE READ THESE TERMS CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS.

1. The TheTravella Platform

TheTravella provides a platform that enables registered users ("Hosts") to list vehicles for rent ("Vehicles") and other registered users ("Guests") to book Vehicles. Hosts alone are responsible for their Vehicles and Services. When Members make or accept a booking, they are entering into a contract directly with each other. TheTravella is not and does not become a party to any contractual relationship between Members.

2. Eligibility

To access and use the Platform, you must be at least 18 years old. By accessing or using the Platform, you represent and warrant that you are 18 or older.

For Guests: To book a Vehicle, you must hold a valid driver's license. We may ask you to provide proof of identity and driver's license validity.

For Hosts: To list a Vehicle, you must be the registered owner or have the full legal right to rent out the Vehicle.

3. User Accounts

You must register an account to access features of the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use, or suspected unauthorized use of your account or any other breach of security.

4. Fees and Payments

Service Fees: TheTravella charges fees to Hosts (typically 15-25% of the trip price) and/or Guests for use of the Platform. These fees are disclosed before booking.

Trip Price: The Host sets the Trip Price. The Host is solely responsible for determining the Trip Price (including any applicable taxes).

Payments: Payments are processed securely via our third-party payment providers (e.g., Stripe, Flutterwave). By providing a payment method, you authorize us to charge the applicable fees.

5. Cancellation and Refunds

Cancellations are governed by the policy selected by the Host for their listing (Flexible, Moderate, or Strict). Refunds are processed according to the applicable cancellation policy.

  • Guest Cancellation: Guests may cancel a booking according to the listing's cancellation policy.
  • Host Cancellation: Hosts should avoid cancelling confirmed bookings. Cancellations by Hosts may result in penalties, fees, and account suspension.

6. Prohibited Activities

In connection with your use of the Platform, you will not and will not assist or enable others to:

  • Breach or circumvent any applicable laws or regulations, agreements with third-parties, third-party rights, or our Terms and Policies.
  • Use the Platform for any commercial or other purposes that are not expressly permitted by these Terms.
  • Copy, store, or otherwise access or use any information, including personally identifiable information about any other Member, contained on the Platform in any way that is inconsistent with TheTravella's Privacy Policy.
  • Use the Platform to request, make, or accept a booking independent of the Platform, to circumvent any Service Fees or for any other reason.
  • Discriminate against or harass anyone on the basis of race, national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age, or sexual orientation.

7. Liability and Vehicle Responsibility

Hosts: You are responsible for ensuring your Vehicle is safe, roadworthy, and compliant with all laws. You understand that use of the Platform does not replace your own legal or vehicle-compliance responsibilities.

Guests: You are responsible for returning the Vehicle in the condition it was in at the start of the trip (excluding normal wear and tear). You are responsible for your own acts and omissions and are also responsible for the acts and omissions of anyone you invite to join or provide access to the Vehicle.

TheTravella Liability: TheTravella is not liable for any incidental, special, exemplary, or consequential damages, including lost profits, loss of data, or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services.

8. Dispute Resolution

If a dispute arises between you and TheTravella, our goal is to provide a neutral and cost-effective means of resolving the dispute quickly. Before resorting to legal proceedings, we strongly encourage you to first contact us directly to seek a resolution.

9. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
