Introduction

Welcome to Travella! Travella provides a platform that connects car owners who want to rent out their vehicles with individuals seeking to rent vehicles. This Terms of Service agreement ("Agreement") outlines the terms and conditions governing your use of the Travella platform, including our website, mobile applications, and all related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by this Agreement. If you do not agree to these terms, please do not use our Services. This Agreement constitutes a legally binding contract between you and Prodev Innovations Limited ("Company," "we," "us," or "our").

Eligibility, registration, verification

Age Restrictions: You must be at least 18 years of age to create an account. However, you must be at least 21 years of age to rent a vehicle through our platform, unless otherwise stated for specific vehicles.

Account Creation: To use certain features of our Services, you must create an account with accurate, complete, and updated information. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account.

Identity Verification: We may require various forms of identity verification, including but not limited to a valid driver's license, proof of insurance, and payment information. By submitting this information, you authorize us to conduct verification checks, which may include background checks and driving record reviews.

Fees, taxes

Service Fees: We charge service fees for the use of our platform. These fees vary based on the rental price, duration, and other factors. All applicable fees will be displayed before you confirm a booking.

Taxes: You are responsible for paying all applicable taxes associated with your rental transactions. We may collect and remit certain taxes on your behalf where required by law.

Payment Processing: Payments are processed through our secure payment system. You agree to provide accurate payment information and authorize us to charge the designated payment method for all applicable fees.

Your commitments

As a user of our Services, you agree to:

• Provide accurate and truthful information about yourself and your vehicles
• Respect the terms of all rental agreements you enter into
• Use vehicles only for lawful purposes and in accordance with all applicable laws
• Return rental vehicles in the same condition as received, subject to normal wear and tear
• Communicate respectfully with other users of the platform
• Report any accidents, damage, or issues promptly
• Not engage in discriminatory behavior against any user based on race, religion, national origin, disability, sexual orientation, gender identity, or any other protected classification

Content

User Content: Our platform allows you to post content, including vehicle listings, reviews, and comments. You retain ownership of your content, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content for the purpose of providing and promoting our Services.

Content Guidelines: All content must comply with our Community Guidelines and must not:

• Infringe on the intellectual property rights of others
• Contain false, misleading, or deceptive information
• Include offensive, abusive, or inappropriate material
• Violate any applicable laws or regulations

Prohibited activities

The following activities are strictly prohibited on our platform:

• Creating multiple accounts or providing false information
• Using the platform for illegal activities or to facilitate illegal activities
• Manipulating the platform's algorithms or systems
• Extracting data from the platform through scraping or other automated means without our explicit permission
• Harassing, intimidating, or discriminating against other users
• Using vehicles for commercial purposes unless explicitly permitted
• Subletting or transferring a rental agreement to a third party
• Violating traffic laws or operating vehicles recklessly

Other legal matters

Limitation of Liability: To the maximum extent permitted by law, Travella shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

Indemnification: You agree to indemnify and hold harmless Travella and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of or in connection with your use of the Services, your content, or your violation of this Agreement.

Dispute Resolution: Any disputes arising out of or related to this Agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.

Specific terms for guests

Rental Eligibility: To rent a vehicle, you must meet all eligibility requirements, including age requirements, valid driver's license, and satisfactory driving record.

Insurance Requirements: All rentals through our platform include insurance coverage. However, you may be responsible for a deductible in the event of an accident or damage.

Vehicle Use Restrictions: You must use the rental vehicle only for personal use and in accordance with the terms of the rental agreement. Prohibited uses include but are not limited to: racing, off-roading (unless specifically permitted), use for illegal activities, and transporting hazardous materials.

Booking and Cancellation: When you book a vehicle, you enter into a rental agreement with the vehicle owner. Cancellation policies vary and are displayed before booking. You are responsible for reviewing and complying with these policies.
